Section 9 (extract):
(1) Subject to the foregoing provisions, no person shall divert, dam, store, abstract, use, or discharge any effluent into, public water or for any such purpose construct any works, except in accordance with a water right granted under this Act: Provided that nothing in this section shall prevent the continuation of existing

Section 4:
(1) No person shall undertake or implement an activity prescribed under section 3 unless —
(a) such person has applied to a licensing authority for authorization to undertake such activity and authorisation has been issued under section 12; and
(b) the environmental impact of the proposed activity is fully taken into account in accordance with the provisions of this Act.

Regulation 3:. Subject to section 3 of the Act, activities, locations, thresholds and criteria to which the Act applies shall be as set out in Schedule 1 to these Regulations.

(1) The functions of a conservation committee shall be-

(b) to attempt to persuade any owner or occupier of land in its area of jurisdiction to adopt such methods of farming or land use as it may deem necessary for the purpose of conserving soil fertility and protecting agricultural resources;

(e) generally to assist in measures for the preservation, wise use and improvement of agricultural resources within its area of jurisdiction;
(f) to stimulate public interest in the conservation of agricultural resources

Section 3 (extrat):
(2) Any person who undertakes or implements an activity in contravention of subsection (1) commits an offence and is liable to a fine
not exceeding P100 000, or to a term of imprisonment not exceeding five years, or to both.
(3) A person who contravenes subsection (1) shall rehabilitate the area affected by the adverse environmental impact of the implemented activity.
(4) In this section, “rehabilitate” means the reinstatement or restoration to a normal or functional environmental state.
(5) A person who fails to rehabilitate the area referred to under subsections (3) commits an offence and is liable to a fine not exceeding P1 000 000, or
to a term of imprisonment not exceeding 15 years, or to both.

Any person who contravenes the provisions of this Act for which no penalty is otherwise provided and is convicted of an offence shall be liable to a fine not exceeding P50 000, or to a term of imprisonment not exceeding two years, or to both.

Section 17:
(1) When the owner or occupier of land is served with a conservation order or is affected by a conservation regulation under the provisions of section 16, he may apply in writing to the Board to direct any person resident on or using land or having any right in or over land to which the conservation order or conservation regulation relates, to refrain from doing any act on the said land which would prevent or hinder compliance with the said conservation order or conservation regulation, and the Board may give such direction to any such person as it may consider reasonably necessary to enable the said conservation order or conservation regulation to be carried out.
(2) Any person who refuses or neglects to carry out or comply with any direction given by the Board under the provisions of subsection (1) shall be guilty of an offence

Section 29:
A person guilty of an offence under this Act shall be liable to a fine not exceeding P1000 or to imprisonment for a term not exceeding 12 months, or to both.
